Existing IP laws are designed for predictability and clarity, primarily based on human-centric creation processes. These laws assume a clear creator or a group of creators who can be identified and attributed ownership and rights over their creations. However, the advent of Generative AI disrupts this framework. The new modes of creative production enabled by Generative AI involve various forms of direct and indirect contributions, blending human and machine labor. The patent system, designed to protect inventions and innovations, also faces challenges with AI. There are debates about whether AI can be an 'inventor' and how to handle inventions that AI systems autonomously generate.

In the case of Generative AI, IP laws are optimized to protect the interests and profits of the developers of the AI. It fails to address the fair distribution of benefits derived from AI-generated works and the recognition and protection of contributions from the many unseen individuals whose work has indirectly fed into the training of the AI model.
